Five Traffic Stops That Can Turn a Night Out in Mammoth Into a DUI Arrest
It's a familiar Mammoth evening. You've spent a couple of hours at a bar off Main Street and had three beers. You feel fine, so you head to your car and start the short drive home.
What you don't know is that your tail light is out.
Within minutes, red and blue lights fill your mirror. The stop is for a minor Vehicle Code violation, but when you roll down your window, the officer reports "the odor of an alcoholic beverage." Suddenly a routine traffic stop becomes a DUI investigation: field sobriety tests, a breath test, and possibly handcuffs.
Most DUI arrests don't begin with dangerous driving. They begin with a small technical violation that gives officers a reason to pull you over. Here are the ones we see most often in Mammoth Lakes.
1. The "California Roll" at the Frontage Road Stop Sign
The stop sign where Frontage Road meets Main Street is one of the most common places drivers get pulled over. Slowing down and rolling through is not a stop. California law requires a complete stop at the limit line, and officers are watching for anything less.
2. Speeding on Main Street
Late at night, Main Street can feel like an empty two-lane highway. It isn't. Even a few miles over the limit is enough to justify a stop, so ease off the gas and give officers no reason to follow you.
3. Skipping Your Turn Signal
Signal every turn and every lane change, even when the streets look deserted. California courts have held that a signal isn't always legally required when no other vehicle could be affected, but that argument belongs in a courtroom, not on the side of the road at midnight. Don't hand law enforcement an easy reason to stop you.
4. Expired or Missing Registration Tags
Expired tags and missing plates are among the easiest violations for an officer to spot, and among the most common reasons for a stop. Check your registration and make sure your tags are current and properly displayed.
5. Anything Hanging From Your Rearview Mirror
California law prohibits objects that obstruct the driver's view, and officers frequently use items hanging from the mirror as grounds for a stop.
Our firm recently challenged exactly this kind of stop. Our client was pulled over and arrested for DUI because a prayer bead necklace was hanging from his rearview mirror. We filed a motion to suppress the evidence, and after hearing testimony and argument, the Court agreed that the necklace did not obstruct our client's view in any way. The motion was granted, and the DUI was dismissed.
That was a win, but it's a fight you never have to have. Take down the air fresheners, rosaries, parking passes, and anything else hanging from your mirror.
Where Officers Wait After Dark
Late at night, Mammoth Lakes police often position themselves in a few predictable spots: the Motel 6 parking lot, along Main Street near Lupin and Joaquin, and around Canyon Lodge during après-ski. Drive with extra care in these areas.
The Best Defense Is a Safe Ride Home
If you've been drinking, the smartest choice is always a sober driver, a rideshare, or a taxi. But if you've already been stopped and arrested, what happens next matters. A traffic stop must be legally justified, and when it isn't, the evidence that follows can be thrown out, just as it was for our client.
